Creación de la Brigada investigadora de delitos contra PI en Chile

Dentro del más bien sombrío panorama que se cierne sobre el respeto por la Propiedad Intelectual en Chile, cabe destacar la reciente creación de la Brigada Investigadora de Delitos contra la Propiedad Intelectual.

El objetivo de esta unidad es mitigar los delitos vinculados con la Ley 17.336 sobre Propiedad Intelectual; la Ley 19.039 de Propiedad Industrial, y todos los tratados de libre comercio y demás decretos que tengan que ver con ambas leyes. Esto permitirá inyectar una dinámica más ágil, eficiente y eficaz a la función policial, conforme a los requerimientos del organismo de persecución penal.

La nueva brigada, dependiente administrativa y disciplinariamente de la Jefatura Nacional de Delitos Económicos, se suma en la investigación de una variada gama de flagelos mercantiles, sumando fuerzas a las Brigadas Investigadoras de Delitos Económicos, Cibercrimen, Lavados y Activos, y Delitos Portuarios.

Desde inicios de 2008 a la fecha la Bridepi hay incautado más de 45 mil artículos falsificados relacionados con delitos de propiedad industrial, así como también, más de 350 mil productos piratas listos para ser comercializados en Chile, y que atentan directamente a grandes empresas, las cuales se ven seriamente perjudicadas por la violación de los derechos de propiedad intelectual, especialmente en rubros asociados a la industria del cine, literatura y música, entre otros.

Iniciativas como éstas son las que nuestro país necesita para saldar esta deuda que aun tiene pendiente para -entre otros objetivos- salir de la lista roja -o de observancia prioritaria- en que Estados Unidos nos tiene, por considerar que no protegemos los derechos de propiedad intelectual.

Creation of the Investigative Brigade of Crimes against IP in Chile

Within the rather shaded panorama that hovers over the respect for Intellectual Property in Chile, it is important to emphasize that the civil Chilean police recently has created a special division: the Investigative Brigade of Crimes against Intellectual Property (BRIDEPI).

The goal of this new police unit is to mitigate the crimes linked with the Law 17.336 on Intellectual Property and the Law 19.039 of Industrial Property, in accordance with the commitments assumed by Chile through international agreements that have relation with both laws. This will allow injecting a more agile, efficient and effective dynamic to the police function, in accordance with the requests of the criminal pursuit organism.

The new brigade, administratively and disciplinarily dependant of the National Headquarters of Economic Crimes, joins in the investigation of a varied scale of mercantile scourges, adding forces to the Investigative Brigades of Economic Crimes, Cybercrime, Money laundering and Assets, and Port Crimes.

Since its creation, beginning of 2008 to this date, the BRIDEPI has seized more than 45 thousand counterfeit goods related to crimes of industrial property, as well as more than 350 thousand pirated products ready to be commercialized in Chile, which were clearly attempting against the intellectual property rights of large companies, many of which are foreign companies, whose intellectual property rights would be seriously harmed by such infringements, especially those associated with the industry of the cinema, literature and music.

Initiatives such as these made by the Chilean police is what this country needs to even the outstanding debt with the international community and developed countries in particular, so that -amongst other goals- be removed from the priority watch list in which the United States maintains Chile, because it does not consider that it adequately protects the intellectual property rights of transnational companies.

This new police unit is a clear signal of the importance given by the Chilean government to the enforcement of Intellectual Property rights.
