REGULATIONS ON CONTROL OF CHEMICAL SUBSTANCES THAT COULD BE USED IN THE FABRICATION OF ILLICIT DRUGS
On April 17th, 2007, the decree N° 1358, of the Ministry of Home Affairs was published in the official Gazette, establishing a set of rules to control chemical substances that could be used in the fabrication of illicit drugs. |
NORMAS SOBRE CONTROL DE SUSTANCIAS QUÍMICAS SUSCEPTIBLES DE SER UTILIZADAS EN LA FABRICACIÓN DE DROGAS ILÍCITAS
Con fecha 17 de abril de 2007, se publicó en el Diario Oficial el Decreto Nº 1.358 del Ministerio del Interior, que establece medidas de control de sustancias químicas susceptibles de ser utilizadas en la fabricación de drogas ilícitas. |
To that end, the decree provides for registration and information obligations and sanctions in case of infringement. |
Para tales efectos se establecen obligaciones de inscripción e información y sanciones para los infractores. |
The decree contains an initial list of 65 controlled substances, including most salts and composites that derive therefrom. |
El decreto contiene un listado inicial de 65 sustancias sujetas a control, incluyendo en general sales y mezclas derivadas de la utilización de las mismas. |
This decree also creates a special Register of Controlled Chemical Substances Users and provides for mandatory registration of both individuals and legal entities that use and distribute controlled chemical substances. Only registered individuals or legal entities may import, export, produce, manufacture, and distribute controlled substances. |
Mediante este reglamento se crea el Registro Especial de Usuarios de Sustancias Químicas Controladas y se establece la obligación de inscribirse en él para todas aquellas personas naturales o jurídicas que utilicen o comercialicen sustancias químicas controladas. Sólo podrán fabricar, producir, importar, exportar o preparar las sustancias químicas controladas las personas inscritas en el mencionado registro. |
Additionally, registered individuals and legal entities must report all suspicious operations; keep an inventory and a register of the movements of the controlled substances; report in advance importation and exportation of such products. Also, government officials may inspect the facilities of registered individuals or legal entities. |
Adicionalmente, los inscritos en el registro deben cumplir la obligación de informar acerca de operaciones sospechosas; de llevar un inventario de las existencias y un registro de movimientos de las sustancias químicas controladas; de informar en forma previa las operaciones de importación y exportación de estas sustancias. El Ministerio del Interior queda facultado para efectuar inspecciones a las personas inscritas en el Registro. |
Finally, the decree establishes a procedure to impose fines between 40 to 1000 UTM, in case of breach of the obligations contained in this regulation. |
Por último, se establece un procedimiento para la aplicación de multas de 40 a 1.000 UTM por incumplimiento de las obligaciones impuestas en este reglamento. |
