NEW INDUSTRIAL PROPERTY LAW IN FORCE IN CHILE Today, December 1st, the Chilean Official Gazette published the Regulations of the new Industrial Property Law, which harmonizes the Chilean legislation with the Agreement on Trade Related Aspects of Industrial Property Rights (TRIPS). The new Law, published in the Official Gazette on March 11, 2005, specifically stated that it would come into effect once its respective Regulations were published in the Official Gazette. In general terms, the new Law i) extends its protection to objects not recognized in the former code, ii) amends the protection statute for existing industrial privileges, iii) awards improved protection tools to owners affected by infringements to their rights and iv) expedites the procedure for the obtainment of an Industrial Privilege. | NUEVA LEY DE PROPIEDAD INDUSTRIAL VIGENTE EN CHILE Se ha publicado hoy, 1º de Diciembre de 2005, en el Diario Oficial, el Reglamento de la nueva Ley de Propiedad Industrial que cumple con adecuar la normativa chilena a las exigencias dispuestas por el ADPIC (Acuerdo sobre los aspectos de los Derechos de Propiedad Intelectual relacionados con el Comercio). Por expresa disposición de la nueva Ley, ésta comenzaría a regir una vez que se publicase en el Diario Oficial su respectivo Reglamento. A grandes rasgos, la nueva ley, i) extiende el ámbito de protección a objetos que la antigua normativa no reconocía, ii) modifica el estatuto de protección de privilegios industriales ya existentes, iii) confiere mayores herramientas de protección a los titulares afectados por una infracción de su derecho y iv) agiliza el procedimiento tendiente a la obtención de un Privilegio Industrial.
