Chile’s patent and trade mark authority has never before recognised a European product with that distinction.

The wine industry is another sector in which Alessandri has built up its IP practice. It serves as counsel to a large number of vineyards, including the trade association Asociación Gremial de Vinos de Chile, which represents more than 100 vineyards across the country. Countries in Latin America and the Caribbean are cracking down on trademark squatters, combating pirates with tougher border measures and expanding IP rights to bring them in line with those in more developed countries. In particular, well-known and famous brands are gaining increased protection in Latin America as a result of international agreements and precedents set by recent cases.

Thwarting trademark squatters in Chile

In Chile, a new bill being considered by the country’s Congress aims to increase protection for brand owners but may meet with objections on constitutional grounds. The Chilean Industrial Property Law, which was published in March 2005, would bring the country’s law into line with international treaties, including the TRIPS agreement. “This new law will change many very important aspects of the current law,” says Rodrigo Velasco Santelices of Alessandri in Chile, who will be focusing on the proposed legislation during today’s session.

The law would introduce use as a requirement for maintaining ownership of a trademark. At present, Chile is one of few countries which do not have this requirement. The new legislation would allow anyone to file a cancellation action against a trademark on the grounds of non-use. Velasco says this aspect of the law will have important consequences for brand owners, particularly in the pharmaceutical industry.

In Chile, it is common practice to register and not use a trademark. “This has also unfortunately helped trademark piracy,” says Velasco. “If you don’t have use requirements it’s very easy to obtain a trademark registration because the legitimate owner of that trademark can’t file a cancellation due to non-use. I think this amendment has the intention of fighting piracy.”

The practice of registering a trademark with no intent to use it in the foreseeable future was partly due to the fact that historically, it took a long time to register a trademark—as long as four to five years if appeals were filed.The law requires certain types of products, such as new drugs, to have a corresponding trademark registered before they are launched. As a result, pharmaceutical companies have many stock trademarks registered.

In recent years, the Chilean government has made efforts to improve the efficiency of the registration process. The Chilean trademark office has now been separated from other branches of the government and given more resources, and it is now possible to file trademark applications online. Velasco says that an application without objections is now typically granted within a year. In a few cases, he has seen a registration completed in as little as eight to 10 months from the filing date.

The new law would also allow marks that are not intrinsically distinctive to be registered if they have acquired distinctiveness through use in the Chilean market; boost protection for famous marks and allow certain nontraditional marks to be registered for the first time; and expand protections for geographic indications and designations of origin, which were previously limited to the wine industry.

In addition, it would allow brand owners to register 3D, color, smell and sound trademarks. At present, sound marks can only be registered if they can be represented graphically as a musical score. “If the new law is approved, people could obtain registrations for simple sounds such as the noise of a HARLEY DAVIDSON motorcycle, which is a trademark in the United States,” says Velasco. “Up until now, it wouldn’t have been possible to register that sound as a trademark in Chile.”

El Comité Ejecutivo de la Asociación Interamericana de la Propiedad Intelectual (ASIPI) designó a Rodrigo Velasco como árbitro de esa entidad. El único chileno que obtuvo este nombramiento recibió la distinción en La Habana el 17 de marzo pasado. Para ser nombrado árbitro, es necesario ser miembro de ASIPI por lo menos desde hace cinco años, tener 15 años de experiencia trabajando en Propiedad Intelectual y certificar experiencia como conciliador, mediador o árbitro.

El socio de Alessandri es también árbitro de la Organización Mundial de la Propiedad Intelectual (OMPI) y Embajador Regional para la PI en Chile de la Cámara Internacional de Comercio (ICC). La labor de los árbitros de propiedad intelectual es dirimir los conflictos que se presentan en materias relacionadas con marcas, derecho de autor, nombres de dominio, patentes y modelos industriales, entre otras.

El estudio Alessandri incorporó a su gerente general, Cristián Pérez, como socio.

Pérez no es abogado, sino ingeniero civil industrial de la Universidad Federico Santa María.

Éste y otros cambios son parte de la renovación que esta oficina está llevando a cabo como parte del cumplimiento de sus 120 años de vida.

Entre otras novedades, están realizando un estudio de arquitectura de marca, que los llevó a entrevistar a decenas de clientes —a través de una empresa de branding—, modificando su imagen corporativa, y consolidando sus dos áreas de asesoría: las consultoras tributaria y ambiental.

Entre tanto mito y polémica fútil, se echa de menos algo más de sentido común en las políticas públicas sobre el mundo digital.

La noticia convulsionó internet: Instagram, la taquillera red social de fotos, había cambiado sus políticas de privacidad, atribuyéndose derechos sobre las imágenes de sus usuarios. Medios que llamaban al pánico, comentaristas que hablaban de traición y hasta grupos organizados para protestar en Facebook. “Me siento violada”, deslizó por ahí una socialité chilensis, con miles de seguidores de sus jugosas publicaciones personales. Värde Partners Inc. adquirirá FirstCity Financial Corporation

FirstCity Financial Corporation and Värde Partners, inc., alcanzaron un acuerdo de fusión bajo el cual, los fondos administrados por Värde comprarán FirstCity.

Alessandri actuó como asesor de Värde y colaboró con la coordinación del proceso de diligencias debidas (Due diligence), en relación con las subsidiarias de First City en Chile incluyendo Servinco, una de las principales empresas de cobranza en Chile, que presta servicios a la mayoría de los bancos y organismos del sistema financiero del país.

El monto de la transacción fue de USD $225 millones.

El caso fue liderado por Felipe Cousiño Prieto en colaboración con Guillermo Correa, Cristóbal Riffo y Alfonso Muñoz

La fusión afecta a los negocios en países tales como USA, México, Brasil, Perú y Europa.

Alessandri gana batalla por marca Sex and the City

Santiago, 23 de noviembre de 2012. La firma de abogados Alessandri & Compañía acaba de adjudicarse una nueva batalla legal en un área en la cual ya es ampliamente reconocida, la propiedad intelectual y el derecho del entretenimiento. Home Box Office (HBO) de Estados Unidos acaba de ganar un juicio poco común: el reconocimiento de Sex and the City como una marca famosa y notoria más allá de cualquier clase.
